General Rental Conditions and Rules of Use for Accommodation

On the one hand, MJM Rural Homes SL as owner/manager of the accommodation, and on the other hand, the main guest, whose details are stated in the reservation.

EXPRESS

  • That the property object of this contract is a luxury rural farmhouse located in Veïnat de Viella, s/n, 17468 Vilademuls (Girona), registered as a dwelling for tourist use (HUT) with Inscription Number in the Tourism Registry of Catalonia (NIRTC) HUTG-078689- 07 and with maximum authorized capacity for 15 people.
  • That the present contract regulates the conditions of use and enjoyment of the dwelling, in accordance with the regulations in force in Catalonia.

CLAUSES

1. Purpose and scope of the rental

The rental is made exclusively for holiday stays, through the modality of housing for tourist use, for a maximum of 15 people accommodated and for a period not exceeding 30 consecutive days per reservation.

2. Services included

  • The price includes initial and final cleaning, bed linen and towels.

  • The use of the facilities (swimming pools, sauna, gym, soccer field, etc.) is included, as long as it is done in a reasonable and appropriate way, according to the instructions and rules of the property.

3. Cancellation policy

  • The guest will be entitled to a refund of 80% of the total amount of the reservation if he/she cancels at least 30 days prior to the arrival date.

  • If the cancellation is made less than 30 days in advance, no refund will be made.

4. Security deposit

  • A pre-authorization of 500 € will be made on the main guest's credit card on the day of arrival.
  • The deposit will be returned within a maximum of 5 days after departure, once the condition of the property and its facilities have been checked.

5. Internal rules

  • Check-in time (check-in): from 14:00.

  • Check-out time: before 12:00 noon.

  • Parties and events are strictly forbidden.

  • No noise between 00:00 and 07:00.

  • Pets are not allowed.

  • Smoking inside the house is forbidden.

  • The use of the facilities must be responsible and in accordance with the instructions provided.

  • The maximum number of visitors, in addition to the guests, is 20 people, and they must be previously communicated and authorized.

  • It is forbidden to sublet or assign the use of the property to third parties.

  • It is forbidden to install professional sound equipment or similar without express authorization.

  • It is forbidden to carry out commercial activities, filming or professional photographic sessions without prior authorization.

  • The maximum capacity authorized by the tourist license must be respected at all times.

  • The guest will be responsible for damages caused during the stay, even if they exceed the amount of the deposit.

  • Obligation to follow the instructions for use and safety of all facilities, especially swimming pool, sauna and gym.

  • Obligation to leave the property in a reasonable state of cleanliness and order at the end of the stay.

  • Any incident, breakdown or damage must be reported immediately to the owner or manager.

  • It is forbidden to make any modification, work or alteration to the property.

  • It is forbidden to set off fireworks in the whole property.

  • The use of open fires, unauthorized barbecues or candles inside is prohibited unless expressly authorized.

  • Minors are not allowed in the pool, sauna or gym without the supervision of a responsible adult.

  • The use of the pool, sauna and gym is subject to the safety rules posted in the house. The owner is not responsible for accidents resulting from negligent use.

6. Maintenance access

  • The guest accepts the access to the property, during the stay, of authorized personnel for the maintenance of gardens, swimming pool, facilities or urgent repairs, as long as it is previously communicated and carried out at reasonable hours.

7. Keys and access

  • The cost of replacement of keys due to loss will be 50 €.

  • If the owner or manager must come to open the property outside the agreed timetable due to loss of keys, an additional charge of 50 € will be applied.

8. Protection clauses against improper uses

  • Failure to comply with any of the rules may result in early termination of the contract, loss of the deposit and possible claim for damages.

  • It is forbidden to use the property for any activity contrary to the law, morality or public order.

  • The owner reserves the right of access to the apartment, with prior notice and for justified reasons (urgency, maintenance, inspection).

  • The tenant is responsible for the safekeeping of keys and remote controls, and must pay the cost of replacement in case of loss.

  • Failure to comply with municipal, regional or state regulations on tourist housing will be cause for immediate termination of the contract.

9. Insurance and liability

  • The property has specific liability insurance for tourist homes. The guest will be responsible for any damage caused by him, his companions, visitors or guests, as well as for personal belongings not covered by the insurance.

10. Applicable Law and Jurisdiction

  • This contract shall be governed by Spanish law and, in particular, by the autonomous regulations of Catalonia on housing for tourist use.

  • For any divergence derived from the interpretation or fulfillment of this contract, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Girona.

This contract and its terms and conditions are deemed expressly accepted by the guest upon formalizing the reservation through the corresponding platform, constituting sufficient proof of the willingness of both parties to be bound by the terms set forth herein.
