General Rental Conditions and Rules of Use for Accommodation
On the one hand, MJM Rural Homes SL as owner/manager of the accommodation, and on the other hand, the main guest, whose details are included in the reservation.
EXPLAIN
I. That the property object of this contract is a luxury rural farmhouse located in Veïnat de Viella, s/n, 17468 Vilademuls (Girona), registered as housing for tourist use (HUT) with Registration Number in the Tourism Registry of Catalonia (NIRTC) HUTG-078689- 07 and NRU ESFCTU00001702700012572400000000000000000HUTG-0786893 with maximum authorized capacity for 15 people.
II. That this contract regulates the conditions of use and enjoyment of the dwelling, in accordance with the regulations in force in Catalonia.
CLAUSES
1. Object and scope of the lease
The rental is exclusively for holiday stays, through the modality of tourist accommodation, for a maximum of 15 people accommodated and for a period not exceeding 30 consecutive days per reservation.
2. Included Services
The price includes initial and final cleaning, bed linen and towels.
The use of the facilities (swimming pools, sauna, gym, football field, etc.) is included, provided it is done in a reasonable and appropriate manner, in accordance with the instructions and rules of the property.
3. Cancellation Policy
The guest will be entitled to a 90% refund of the reservation deposit amount if they cancel at least 30 days prior to the check-in date.
If the cancellation occurs less than 30 days in advance, no refund will be issued.
4. Bail and security deposit
A pre-authorization of €500 will be made on the main guest's credit card on the day of arrival.
If the guest does not provide a credit card for the pre-authorization of the deposit, it can also be made by bank transfer or in cash.
The deposit will be refunded within a maximum of 5 days after departure, once the condition of the property and its facilities has been checked.
5. Internal regulations
Check-in time: from 4:00 PM.
Check-out time: before 12:00.
Holding parties and events without prior authorization is strictly prohibited.
No noise allowed between 00:00 and 07:00.
Before the start of their stay at Mas Joanmiquel, the guest must provide the landlord with all the identification details required for mandatory registration with the Mossos d'Esquadra (Catalan Police) and the Ministry of the Interior (Royal Decree 933/2021) for all occupants. Failure to comply will result in immediate cancellation without refund or access to the accommodation.
Pets are allowed only with prior authorization and with limited access to the garden. They are strictly prohibited from entering the house. An extra charge of €30 per pet per day applies; please specify this amount when booking. If evidence of pets entering the house is found (hair, damage), the full security deposit (€500) will be charged and is non-refundable, at the owner's discretion.
Smoking is strictly prohibited inside the property. Failure to comply with this rule will result in the full deposit (€500) being charged and not refunded.
The use of the facilities must be responsible and in accordance with the instructions provided.
The maximum number of visitors, in addition to those staying at the hotel, is 20 people, and they must be notified and authorized in advance.
It is prohibited to sublet or transfer the use of the property to third parties.
It is forbidden to install professional sound equipment or similar without express authorization.
It is forbidden to carry out commercial activities, filming or professional photo shoots without prior authorization.
The maximum occupancy authorized by the tourist license must be respected at all times. The guest will be responsible for any fines or penalties resulting from exceeding this occupancy limit.
The guest will be responsible for any damage caused during the stay, even if it exceeds the amount of the deposit.
Obligation to follow the instructions for use and safety of all facilities, especially the swimming pool, sauna and gym.
Obligation to leave the property in a reasonable state of cleanliness and order at the end of the stay.
Any incident, breakdown or damage must be reported immediately to the owner or manager.
It is forbidden to make any modification, work or alteration to the property.
The launching of fireworks is prohibited throughout the property.
The use of open fires, barbecues, or candles is prohibited indoors without express authorization. Between March 15th and October 15th, any outdoor fires, barbecues, or pyrotechnic activities are strictly prohibited in accordance with local regulations to prevent the risk of forest fires. The guest assumes all responsibility for non-compliance, releasing MJM Rural Homes SL from any liability (fines, damages, or fires). In the event of detection, the entire security deposit will be retained, and additional damages will be claimed.
Minors are prohibited from entering the pool, sauna or gym without the supervision of a responsible adult.
Use of the swimming pool, sauna, and gym is subject to the safety regulations posted in the property. The owner is not responsible for accidents resulting from negligent use.
The guest expressly accepts the presence of security cameras in common indoor and outdoor areas of the property, as part of the alarm system. These cameras record video and audio exclusively in common areas, in compliance with data protection regulations (LOPDGDD and GDPR). Information is retained only as long as necessary for security purposes and is automatically deleted, except in cases of incident.
6. Access for maintenance
The guest accepts access to the property, during the stay, of authorized personnel for the maintenance of gardens, pool, facilities or urgent repairs, provided that prior notice is given and it is done at reasonable times.
7. Keys and access
The cost of replacing lost keys will be €50.
If the owner or manager has to come to open the property outside of the agreed hours due to lost keys, an additional charge of €50 will apply.
8. Protection clauses against misuse
Failure to comply with any of the rules may result in early termination of the contract, loss of the deposit and possible claims for damages.
The use of the dwelling for any activity contrary to the law, morality or public order is prohibited.
The owner reserves the right to access the property, after prior notification and for a justified reason (emergency, maintenance, inspection).
The tenant is responsible for the safekeeping of keys and remotes, and must pay the replacement cost in case of loss.
Failure to comply with municipal, regional or state regulations on tourist accommodation will result in immediate termination of the contract.
9. Insurance and liability
The property has specific civil liability insurance for tourist accommodation. The guest will be responsible for damages caused by him, his companions, visitors or guests, as well as for personal items not covered by insurance.
10. Applicable law and jurisdiction
This contract will be governed by Spanish legislation and, in particular, by the regional regulations of Catalonia on tourist accommodation.
For any dispute arising from the interpretation or fulfillment of this contract, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Girona.
In case of discrepancy between the versions in different languages of this contract, the Spanish version shall prevail as the official and binding language.
This contract and its conditions are considered expressly accepted by the guest when formalizing the reservation through the corresponding platform, constituting sufficient proof of the will of both parties to be bound by the terms established herein.
